The petitioner seeks bail in connection with Chhauradano P.S. Case no. 39 of 2017 registered for the offence punishable under Sections 304-B, 201/34 of the Indian Penal Code.
The petitioner along with other accused persons are said to have demanded dowry from the daughter of the informant, subjected her to torture and finally eliminated and cremated her over the said demand.
It is submitted by the learned counsel for the petitioner that the petitioner happens to be brother-in-law of the deceased.
Patna High Court Cr.Misc. No.45894 of 2017 (2) dt.19-09-2017 2/2 He has been living separately from the deceased and has no concern with the affairs of the deceased and her husband. Neither he made any demand nor ever subjected her to torture nor eliminated her. The allegation levelled against the petitioner is not specific rather omnibus. The petitioner has been languishing in custody since 06.03.2017.
Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, East Champaran, Motihari in connection with Chhauradano P.S. Case No. 39 of 2017.
