Petitioner seeks bail in a case registered under Sections 399, 402, 120(B) of the Indian Penal Code and Section 25(1-b)a, 26(ii), 35 of the Arms Act.

Some co-accused were caught by the police when they had assembled to make preparation for committing dacoity. The apprehended co-accused disclosed that it was petitioner who arranged the persons for committing the dacoity. Moreover, it is admitted case of the prosecution that at the time of present occurrence, petitioner had been lodged in Motihari jail. No doubt, petitioner carries criminal antecedent but in the present case except the so-called confessional statement of co-

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., (West), Muzaffarpur in connection with Motipur P.S. Case No.195 of 2015.
