The petitioner seeks regular bail in connection with Karakat P.S.Case No.149 of 2017 registered for offences punishable under Sections 30(a) and 36 of the Bihar Prohibition and Excise Act, 2016.
Allegation against the petitioner is about recovery of 479 ltrs. of liquor.
Submission of the learned counsel for the petitioner is that nothing has been recovered from the house of the petitioner rather from the Bhusaghar. The petitioner has no criminal antecedent and he has remained in custody for about 2 1⁄2 months. Heard learned A.P.P. also.
Having heard both sides and in view of allegation
Patna High Court Cr.Misc. No.44386 of 2017 (2) dt.15-09-2017 this application is disposed of with direction that once the charge is framed or he completes four months in custody, the learned court below shall release the petitioner in connection with Karakat P.S.Case No.149 of 2017 to his own satisfaction. With the aforesaid observation, this application is disposed of.
