The petitioner seeks bail in a case registered for the offence punishable under Sections 302, 394 and 353/34 of the Indian Penal Code and Section 27 of the Arms Act. It is submitted that F.I.R. was lodged against unknown. During investigation the call details of the locality were examined and one of the mobiles was located which was in the name of the petitioner. He has further submitted that the mobile has not been recovered from the possession of the petitioner. Although it was purchased in the name of the petitioner but it was used by his full brother, Rajan Kumar Singh. Rajan has made confession before the police and the mobile has been recovered from his possession. He has further submitted that petitioner is a student of Hotel
Patna High Court Cr.Misc. No.11556 of 2015 (2) dt.13-05-2015 2 / 2 Management and B.Sc. Hospitality and is continuing his studies at Shillong. He has no criminal antecedent. Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran at Chapra in Ishuapur P.S. Case No.145 of 2014 with the following conditions :
1. One of the bailors will be the close relative of the petitioner.
2. The petitioner will not indulge in similar or in any other offence.
3. The petitioner will be well represented in the court.
4. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
