JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 47(A) of Bihar Excise Amendment Act, 2016.

No doubt, seven litres Indian made foreign liquor and ten litres country made foreign liquor are said to have been recovered from the gumti of the petitioner but for the aforesaid offence, petitioner remained in jail custody since 14.05.2016 without having any criminal antecedent.

Learned counsel for the petitioner submits that nothing has been recovered from conscious possession of the

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Excise Case No. 174 C3 of 2016.
