JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2018 Heard the parties. The petitioners seek anticipatory bail in connection with Barun P.S. Case No.97 of 2018, registered for offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 332, 333, 353, 395, 436, 504, 120B of the Indian Penal Code and 3⁄4 Prevention of Damage to Public Property Act.
As per F.I.R., allegation against the petitioners and others is that they entered into police station and setting on fire of several vehicles and also damaged the police station with brickbats and stone chips.
Submission of the learned counsel for the petitioners is that the there are large number of persons were assembled at the
Patna High Court Cr.Misc. No.48506 of 2018 (2) dt.24-08-2018 2/2 place of occurrence and there is no specific allegations have been attributed against the petitioners. It is further submitted that the petitioners were not present on the spot rather they were arrested from their house and the petitioners have no criminal antecedents. Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named on surrender or arrest within six weeks be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No.97 of 2018, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
