The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code.

The informant named 11 persons including the petitioner. It is alleged that Sant Lal Singh assaulted the mother of the informant with a dagger on her forehead. Thereafter the other accused persons assaulted the informant.

It is submitted that the mother of the informant died during the course of treatment. Other accused person, namely, Akhilesh Singh has already been enlarged on anticipatory bail vide order passed in Cr. Misc. No. 14373/2014. Co-accused Sant Lal Singh and Pawan Kumar were granted anticipatory bail by the learned Sessions Judge vide order passed in ABP No. 589/2014. A report was called for from the learned Sessions

Patna High Court Cr.Misc. No.10880 of 2015 (3) dt.02-04-2015 2/2 Judge. The learned Sessions Judge has reported that Sant Lal Singh and Pawan Kumar were granted anticipatory bail on the ground that no specific allegation was made against them and their case stands on the same footing as that of Akhilesh Singh, who was granted anticipatory bail by this Court vide order passed in Cr. Misc. No. 14373/2014.

On perusal of the record, it appears that apparently the case of Sant Lal Singh is on different footing as he is the first assailant of the deceased and he assaulted the deceased with a dagger on her forehead. There is omnibus and general allegation of assault against the petitioner and his case stands on the same footing as that of Akhilesh Singh.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali in Desari P.S. Case No. 55/13, corresponding to G.R. No. 1187/13.
