The petitioner apprehends his arrest for the offences punishable under Section 47(A) of the Excise Act. As per the allegation, 55 liters of Mahua country made liquor and few tools for preparation of country liquor were seized. It is alleged that the petitioner, Nand Lal Rawat, fled away seeing raiding party. Learned counsel submits that the recovery has not been made in the presence of petitioner or his conscious possession and this is the first offence.

Having regard to the facts and circumstances of the case, let the petitioner, namely, Nand Lal Rawat, be released on bail in the event of arrest/surrender before the court below

Patna High Court Cr.Misc. No.36849 of 2014 (2) dt.20-02-2015 2 / 2 within a period of six weeks from today in Jha Jha P.S. Case No.210/2013 dated 12.12.13, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
