JUSTICE SANJAY PRIYA ORAL ORDER 30-08-2017 Heard learned counsel for the petitioner and the State. The petitioner was granted provisional bail by order dated 22.03.2017 passed by this Court in Cr. Misc. 11581 of 2017. Since the petitioner could not fulfill one of the conditions of the aforesaid order, the bail bond could not be executed by him and, thereafter, he filed modification of the aforesaid order which was dismissed by this Court on 12.07.2017 passed in Cr. Misc. 18699 of 2017.

It has been submitted on behalf of the petitioner that the informant is in habit of filing case against him. She has filed Sitamarhi Mahila P.S. Case No. 40 of 2016 in the month of October after filing of this case in which he has already been

Patna High Court Cr.Misc. No.40410 of 2017 (2) dt.30-08-2017 2/2 granted bail by this Hon'ble Court vide order dated 16.02.2017 passed in Cr. Misc. 53247 of 2017. He is in custody in this case since 09.01.2017.

In such circumstances, keeping in view the period spent by the petitioner in custody for about seven months, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Sitamarhi P.S. Case No. 442 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
