The petitioner seeks bail in a case under Sections 379 and 461 of the Indian Penal Code.
The informant, an officer of the State Bank of India, Sultanganj disclosed that from the ATM, an amount of Rs. 20,19,000/- was stolen. The informant simply stated that Arvind Prasad Yadav and Binod Singh, officers of the Bank, were knowing the code of ATM and they can open the ATM. The petitioner was the guard of the ATM. The petitioner was apprehended on mere suspicion.
It appears that during the course of investigation, Rs. 14,36,000/- was found abandoned near the counter of the State Bank of India but the police could not be able to search as to who had put the amount near the counter of the Bank. Till date the
Patna High Court Cr.Misc. No.10103 of 2015 (4) dt.28-07-2015 2/2 investigating officer has not been able to collect any evidence against the petitioner. The petitioner is in jail since 20.04.2015. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in Sultanganj P.S.
