JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is seeking regular bail in Narkatiyaganj Rail P.S. Case No. 44 of 2017 registered under Section 374 IPC and Section 79 of the Juvenile Justice Act.

Learned counsel for the petitioner submits that the petitioner has been arrested on the allegation that he was involved in trafficking of five minor boys without consent of their parents and while taking them to Delhi for their engagement as workmen this petitioner was arrested at Narkatiaganj Railway Station. Learned counsel submits that in fact two boys Md. Anwar Hussain and Md. Nazre Alam, 17 and 15 years respectively who were covillagers of this petitioner, were going with him to meet their

No.44704 of 2017 (2) dt.21-09-2017 2/2 parents; the parents of the minor boys never complained anything against this petitioner and this petitioner has got no criminal antecedent as stated in paragraph 3 of the application. Learned A.P.P. for the State opposed the prayer for bail.

Considering the facts and circumstances, let the petitioner, namely, Md. Firoz, be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Rail Bettiah, West Champaran in connection with Narkatiyaganj Rail P.S. Case No. 44/17, (Gr. No. 3260/17) subject to the conditions as laid down under Section 437(3) Cr.P.C.
