====================================================== CORAM: HONOURABLE MR. JUSTICE KHATIM REZA ORAL ORDER 30-08-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Manjhi P.S. Case No. 218 of 2022 dated 16.06.2022, instituted for the offences punishable under Sections 341, 323

3. The prosecution case, in short, is that the informant got married to the petitioner and soon after marriage petitioner and his family started making dowry demand of Rs. 5,00,000/- (Five Lakhs) and a motorcycle and tortured her on non-fulfillment of the demand. On 21.07.2019, when the informant had gone to her parent's house, she got information that petitioner is planning to get married again. It

Patna High Court CR. MISC. No.55539 of 2023(2) dt.30-08-2023 2/2 is alleged that the informant approached Police Station to stop the petitioner's second marriage but, silently, the marriage was solemnized.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. It is submitted that the petitioner is in custody since 18.05.2023 and earlier he has already served in custody from 17.06.2022 to 02.09.2022, Lastly, it is submitted that he has no criminal antecedents and charge-sheet has been submitted in the case.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Saran at Chapra in Manjhi P.S.
