JUSTICE SUDHIR SINGH ORAL ORDER 02-09-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Section 392 of the Indian Penal Code.

Allegation is that on the point of pistol informant was robbed off his mobile and cash amount of Rs. 1700 by the accused persons.

It has been submitted on behalf of the petitioners that they are in custody since 1.2.2016. Chargesheet has been submitted against the petitioners. Petitioners have got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioners. They are not named in the F.I.R. Their names have come on the basis of their own confession before the police. There is no recovery of any looted articles from the possession of the petitioners.

On behalf of the State, it is submitted that petitioners are not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail

Patna High Court Cr.Misc. No.29509 of 2016 (3) dt.02-09-2016 2/2 bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Supaul P.S. Case no. 52 of 2016.
