====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 03-11-2023 Heard Ms. Priyanka Singh, learned counsel for the petitioner and Mr. Rajendra Singh, learned A.P.P. for the State.

2. The petitioner seeks bail, who is in custody since 10.3.2022 in connection with Phulwariya P.S. Case No. 92 of 2022 dated 10.3.2022 registered for the offence under Sections 285, 286, 427 and 120-B/34 of the Indian Penal Code.

3. The case relates to explosion of explosive substance illegally kept in the house of Halim Miya resultantly Halm Miya and his son got burn injuries.

4. Earlier bail petition of the petitioner was rejected by this Court vide order dated 1.2.2023 passed in Cr. Misc. 34495 of 2022.

5. Vide order dated 1.9.2023, a report was called for

Patna High Court CR. MISC. No.58110 of 2023(4) dt.03-11-2023 2/2 from the learned trial court with regard to present stage of the trial and the same is received. The report dated 11.9.2023 reveals that out of eight charge sheet witnesses, five witnesses have already been examined.

6. Considering the report of the learned trial court, I am not inclined to enlarge the petitioner on bail in connection with Phulwariya P.S. Case No. 92 of 2022 pending in the court of learned Additional Sessions Judge, Gopalganj.

7. Prayer is refused.

8. However, the trial court is directed to expedite the trial and conclude the same at the earliest. (Rajesh Kumar Verma, J) S.Ali/- U
