JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 Petitioner seeks bail in connection with Tariyani P.S. Case No. 18 of 2017, registered for the offence punishable under Section 302 of the Indian Penal Code.

Prosecution case is that petitioner assaulted son of the informant and thereafter strangulated him.

Submission of learned counsel for the petitioner is that dispute arose with respect to scuffle between the children and there is no motive behind the occurrence and he is in custody since 3.5.2019.

Heard learned APP, who has opposed the prayer for bail stating that post mortem report also supports the allegation as cause of death is asphyxia due to strangulation. In view of above facts and circumstances, I am not inclined to grant bail to the petitioner.
