2. The petitioner seeks bail in connection with Sahebpur-Kamal P.S. Case No. 56 of 2025 dated 07.03.2025, instituted for the offence punishable under Sections 126(2), 115(2), 351(1), 351(2), 352, 103(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. The allegation against the petitioner is that he along with other accused persons assaulted the husband of informant as a result of which he died.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that petitioner is the nephew of the deceased. It is next submitted that father and mother of the

No.55809 of 2025(2) dt.12-08-2025 2/3 deceased namely, Dhuto Sah and Sita Devi have stated before the I.O. that the deceased was patient of mental disorder and he used to ill-treat and quarrel with all the family members ever for petty matters and in the night intervening 06.03.2025/07.03.2025 while Ketan Kumar, son of Lakshman Sah was sleeping on the roof, Sulo Sah (deceased) started abusing him leading to some quarrel and scuffle between the deceased, Ketan Kumar, Sanjay Sah and the petitioner and in the meantime, the deceased fell on the bricks, thus, he was taken for treatment of his injuries and in course of treatment, he died. Further submission is that father of the deceased is himself deponent in the instant bail application of the petitioner. The allegation levelled against the petitioner is general and omnibus in nature. Lastly, it has been submitted that the petitioner is in custody since 08.03.2025, he has no criminal antecedents and charge-sheet has been submitted in the case.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount
