JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-03-2015 Petitioner is languishing in custody since 25.02.2014 in a case registered for the offences punishable under Sections 323, 341, 353, 504, 506, 34 of the I.P.C and Section 3(1)(x of the SC & ST (Prevention of Atrocities) Act. It is alleged that the informant being a police officer went inside the jail to take finger print of accused coaccused Amresh Thakur and the petitioner then the informant was abused by calling caste name and gave life threatening. It is submitted by learned counsel for the petitioner that that informant had maliciously roped the petitioner in the present case as well as in three other cases though petitioner is involved in eight other cases. Moreover coaccused Amresh Thakur has been granted bail vide Cr. Misc. No. 31591 of 2014 who also has criminal antecedent. Considering the nature of accusation and

No.10678 of 2015 (2) dt.23-03-2015 2/2 the fact that co-accused has been granted bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, SC/ST Act, Muzaffarpur in connection with Sessions Trial No. 428 of 2014, Trial No. 37 of 2014, arising out of Mithanpura P.S. Case No. 162 of 2013. Since the petitioner has serious criminal antecedent, let learned Court below positively cancel the bail bonds of the petitioner, if the petitioner gets substantially involved in similar nature of offence or defaults for two consecutive occasions during trial.
