Petitioner apprehends his arrest in connection with Belaganj P.S.Case No. 148 of 2015 registered for the offences punishable under Section 307 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner is that he fired at the informant but did not hit anybody.
Submission of learned counsel for the petitioner is that earlier to the present case a case has been lodged by the petitioner against the informant for committing murder of nephew of the petitioner and for that the present false and concocted case has been filed.
Heard learned APP also.
Patna High Court Cr.Misc. No.44705 of 2018 (2) dt.01-08-2018 2/2 Having heard both sides and in the facts and circumstances, let the petitioner, named above, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XI, Gaya, in connection with Belaganj P.S.Case No. 148 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
