JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-08-2019 This application, for grant of anticipatory bail, arises out of Barharia P.S. Case No. 18 of 2019, disclosing offences under Sections 447, 324, 307, 504/34 of the Indian Penal Code. Allegation against the petitioner and others is that they entered inside the house of the informant, while she was taking bath and on protest the petitioner stabbed her on her abdomen, due to which she become unconscious and petitioner and others fled away.
Submission of learned counsel for the petitioner is that he is earning in Arab country and sending the money and due to which, the dispute arose between the parties. Moreover, the injury does not appear to be serious as she has been discharged within 24 hours.
Heard learned A.P.P. as well as learned counsel for the
Patna High Court CR. MISC. No.50785 of 2019(2) dt.16-08-2019 2/2 informant opposed the prayer for bail on the ground that the petitioner has criminal antecedent but he has suppressed the same in his petition.
Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with direction to the court below to verify the criminal antecedent of the petitioner and if it is found that he has no criminal antecedent, the court below shall enlarge the petitioner on bail otherwise, the petitioner will have to surrender and pray for regular bail.
