Petitioner, already in custody, seeks bail in connection with Bidupur P.S. Case No.104 of 2016, registered under Sections 304(B)/34 and 201 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 20.11.2016 and his wife died due to accidental fire as the LPG gas cylinder burst. Learned counsel for the State submits that the allegation is that the deceased was killed in connection with demand of dowry and her dead body was disposed of. In the case diary it transpires that the case of the accused is that the deceased died due to illness but no medical prescription was produced and the petitioner is the husband.

Patna High Court Cr.Misc. No.56803 of 2017 (3) dt.16-01-2018 2 /2 Having considered the said facts and circumstances, the prayer of bail of the petitioner is rejected in connection with Bidupur P.S. Case No.104 of 2016, pending in the court of learned C.J.M., Vaishali.

The trial court is directed to expedite the trial after framing of charge and preferably conclude the same within a year. Let a copy of this order be sent to the Superintendent of Police, Vaishali to ensure production of prosecution witnesses during trial in order to conclude it within stipulated period.
