JUSTICE SUDHIR SINGH ORAL ORDER 01-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 304B/34 of the Indian Penal Code.

Allegation against the petitioner is to have tortured and killed daughter of the informant due to non-fulfilment of demand of dowry.

It has been submitted on behalf of the petitioner that he is in custody since 30.1.2016. Charge has already been framed in the case. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner has falsely been implicated in the present case. From perusal of paras-30, 31 and 32 of the case diary it is evident that the deceased has committed suicide. It is at best a case under Section 306 of the Indian Penal Code. It is further submitted that petitioner may be released after completion of one year in custody, i.e., from 30.1.2016.

On behalf of the State and the informant, it is submitted that petitioner is named in the F.I.R. and is husband of the deceased.

No.29218 of 2016 (3) dt.01-09-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail after completion of one year in custody, i.e., from 30.1.2016 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Hilsa, Nalanda, in connection with Karai-Parsurai P.S. Case no. 9 of 2016.
