The petitioner is languishing in custody since 14.01.2015 in a case registered for the offences punishable under Sections 379/411 of the Indian Penal Code.
Motorcycle of the informant was stolen leading to the registration of the FIR against unknown. It is alleged that on confession of the petitioner the motorcycle of the informant was recovered.
It is submitted by learned counsel for the petitioner that except confession before the police there is no material against the petitioner.
Considering the nature of accusation, let the
Patna High Court Cr.Misc. No.13088 of 2015 (02) dt.06-04-2015 2/2 above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with in connection with Bhabua P.S. Case No. 469 of 2014.
Since the petitioner is accused in two other cases of similar nature, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
