JUSTICE CHAKRADHARI SHARAN SINGH ORAL JUDGMENT Date: 22-02-2017 The petitioner has been declared to be a child in conflict with law in connection with Lakhisarai (Kabaiya) P.S. Case No. 453 of 2014 registered for the offence punishable under Section 302 of the Indian Penal Code and Section 27 of the Arms Act. His application for release on bail was rejected by the Juvenile Justice Board, Lakhisarai by order dated 08.12.2015. The said order subsequently came to be affirmed by an order dated 30.03.2016 passed in Criminal (Juvenile) Appeal No. 1 of 2016 by learned 1st Additional District Judge, Lakhisarai which is under challenge in the present criminal revision application.

No. 2387 of 2016, seeking his provisional release on bail for certain period for participating in last funeral rites of his mother. Along with the said petition, the petitioner brought on record the programme of different rituals to be performed. This Court had required learned Additional Public Prosecutor to seek instructions from the Superintendent of Police, Lakhisarai as to whether the mother of the petitioner had died. It has been reported that the mother of the petitioner is alive. Learned counsel, who were representing the petitioner, thereafter withdrew themselves from the present case considering the conduct of the petitioner.
In the background of the facts, as have been noted above, I do not consider it safe for the petitioner to be released on bail during inquiry under Section 14 of the Juvenile Justice (Care & Protection of Children) Act, 2015.
The application is, accordingly, dismissed.
I.A. No. 2387 of 2016 also stands dismissed.
The said I.A. No. 2387 of 2016 has been affidavited by Ram Kumar @ Ram Kumar Das, who has claimed to be the elder brother of the petitioner. He has thus apparently made false and misleading statement on oath for obtaining an order from this Court.
