JUSTICE ARUN KUMAR ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. Petitioner, already in custody, seeks bail in connection with Sitamarhi P.S. Case No.184 of 2014, registered under Sections 147, 148, 149, 302 and 120(B) of the Indian Penal Code as well as Section 27 of the Arms Act.

It is submitted that there is no eye witness of the murder of the brother-in-law of the informant's brother. Except disclosure of the name of the petitioner by a co-accused Biswajit Kumar @ Bittu Tiwari, there is no material against him and earlier this petitioner had moved for bail but the same was rejected at that stage vide Cr. Misc. No.649 of 2017 on 08.02.2017. Now the investigation has been completed and he has remained in custody for more than a year.

No.43896 of 2017 (4) dt.20-09-2017 2 /2 Having considered the said facts and circumstances, petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Sitamarhi P.S. Case No.184 of 2014 with condition that he shall be present on each and every date before the court below as and when required and if he remains absent on two consecutive dates without any compelling reason, his bail bond shall be liable to be cancelled.
