JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code.

Petitioner is said to be caught on the spot but according to prosecution case itself, the alleged recovery has not been made from conscious possession of the petitioner. Submission on behalf of the petitioner is that while petitioner was going by his motorcycle he was caught by the police officials on suspicion and implicated the petitioner in this case. Petitioner is in jail custody since 08.04.2016 and does not have any criminal antecedent.

Case No. 43 of 2016.
