Petitioner apprehends his arrest in connection with Jainagar P.S.Case No. 152 of 2011 (G.R.No. 1827 of 2011) registered for the offences punishable under Section 376 of the Indian Penal Code.
Allegation as per FIR is that when informant was hospitalized she was raped by the petitioner. Submission of learned counsel for the petitioner is that final form has been submitted against the petitioner finding the case not true but learned Magistrate has taken cognizance against him.
Heard learned APP and on perusal of record it appears that cognizance has been taken in the year 2014 and till date he
Patna High Court Cr.Misc. No.44681 of 2018 (2) dt.01-08-2018 2/2 has not appeared in this case nor moved for anticipatory bail and considering the conduct of the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
