The petitioner is in custody since 01.09.2016 in connection with Motihari Town P.S. Case No. 565 of 2016 for the offence registered under Sections 413, 414/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the alleged recovery was not from his conscious possession and was found, admittedly, standing by the road side, the petitioner was taken into custody on mere suspicion and has since been languishing in jail. It is further submitted that one such accused persons whose motorcycle was also found standing by the road side was taken into custody and he has since been extended the privilege of bail.

No.40834 of 2017 (2) dt.20-09-2017 2/2 Considering the nature of allegation made against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Motihari town P.S. Case No. 565 of 2016.
