JUSTICE ARVIND SRIVASTAVA ORAL ORDER 18-08-2017 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner seeks bail in connection with Sheohar P.S. Case No. 105 of 2015 registered under Sections- 366A/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case as there is land dispute between the parties. In the statement under section 164 Cr. P.C. and in medical report, it has come that no kind of sexual assault has been made. Similarly situated co-accused persons have been granted anticipatory bail.

Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that there is direct allegation

Patna High Court Cr.Misc. No.37283 of 2017 (2) dt.18-08-2017 2/2 against this petitioner.

Considering the nature of allegations levelled and the submissions advanced on behalf of the parties, I do not feel inclined to grant the privilege of bail to the petitioner. His prayer for bail is, therefore, rejected.
