The petitioner is accused in connection with Chandramandih P.S. Case No. 103 of 2015, registered under Section 302 and 120B/34 of the Indian Penal Code and Section 3/4 of Explosive Substance Act.
The accusation is that six persons named in the F.I.R. including the petitioner surrounded to Vivekanand Yadav, father of the informant, and Taitu Tudu @ Ramesh Tudu hurled a bomb causing injury at his head at which he fell down. Thereafter, Ramesh Tudu also threw two more bombs causing injuries on several parts of the body of his father, who died on the spot.
Learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.27817 of 2016 (2) dt.13-07-2016 2/2 though the petitioner along with five others are named in the F.I.R., but there is specific allegation of throwing bombs against accused Taitu Tudu @ Ramesh Tudu. Further submission is that there is no specific overt act against the petitioner. The petitioner having no criminal antecedent is in custody since 21.12.2015. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Addl. District and Sessions Judge, Jamui in connection with Chandramandih P.S. Case No. 103 of 2015 (S.T. No. 107 of 2016).
