The petitioner seeks bail in connection with Vidyapatinagar P.S. Case No.24 of 2016 registered under Section 363 and subsequently added Sections 364, 302 and 201/34 of the Indian Penal Code.

On missing of Kundan Kumar on 06.03.2016, the present case was instituted on 10.03.20126 against unknown on the basis of the written report of the informant, Sitaram Sahani, the father of Kundan Kumar. Later on, the dead body of Kundan Kumar was found in the paddy field of Rayo Chaurasia on 12.03.2016, then the informant again gave fresh written report

Patna High Court Cr.Misc. No.27829 of 2016 (2) dt.14-07-2016 2/2 raising suspicion against the petitioner saying that he came to know that his son on 06.03.2016 had gone to the field of the father of the petitioner for uprooting the potato and in that course, this petitioner had assaulted him and since then his son was missing. Learned counsel appearing on behalf of the petitioner submits that except suspicion, as raised by the informant, father of the victim/deceased Kundan Kumar, there is no material to show the involvement of the petitioner in the present case. The petitioner is in custody since 18.03.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri P.K. Roy, Judicial Magistrate, First Class, Dalsingsarai (Samastipur), in connection with Vidyapatinagar P.S. Case No.24 of 2016.
