The petitioner seeks regular bail in connection with Bihariganj P.S.Case No.175 of 2017, registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is about recovery of 07 ltrs. of liquor.

Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case. Nothing has been recovered from the possession of the petitioner. The petitioner has remained in custody sine 5.6.2017. It has also been submitted that he is accused in one more case but he is on bail in that case.

Patna High Court Cr.Misc. No.44537 of 2017 (2) dt.15-09-2017 Heard learned A.P.P. also.

Having heard both sides and in view of allegation, this application is disposed of with direction that once the charge is framed or he remains in custody for further two months, whichever is earlier, the learned court below shall release the petitioner in connection with Bihariganj P.S.Case No.175 of 2017 to his own satisfaction.

With the aforesaid observation, this application is disposed of.
