A counter affidavit has been filed on behalf of respondent no. 3 in which the stand is that the petitioner is not entitled to pension in terms of the Government letter No. 1069 dated 23.06.1977. It is further the stand that the petitioner had also moved before the Hon'ble Lokayukt, Bihar and the matter was closed in light of such fact as communicated under letter No. 1728 dated 23.11.2001 of the District Superintendent of Education, Saran.

In view of the aforesaid, the application stands disposed off.
