NILU AGRAWAL ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. Petitioner is languishing in judicial custody since 27.05.2017 in connection with Jandaha P.S. Case No. 83 of 2017 for offences punishable under Sections 304(B)/34 of the Indian Penal Code.

The prosecution case, as lodged by the informant, is that his sister Arti Kumari (deceased) was married to one Randhir Kumar Singh, who is son of the petitioner, in the year 2016. For non-fulfillment of demand of motorcycle, the petitioner along with husband of the deceased and other family members killed and hanged her.

It has been submitted by the learned counsel for the

Patna High Court Cr.Misc. No.41979 of 2017 (2) dt.21-09-2017 2/2 petitioner that he is innocent, and the husband of the deceased is posted as accountant in Patna and the petitioner who is the fatherin-law of the deceased was at his village. He submits that general and omnibus allegations have been levelled and there is no specific allegation against the petitioner. He submits that chargesheet has already been submitted and there is no allegation of tampering of the prosecution witnesses by the petitioner. However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XI, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 83 of 2017, subject to the condition that one of the bailors would be a close relative of the petitioner having sufficient immovable property, who will file an affidavit stating his relationship with the petitioner.
