The petitioners apprehend their arrest in Kawakole P.S. Case No. 88/2003, instituted for the offence punishable under Section 364(A) of the Indian Penal Code.

It appears from the impugned order that in the instant case charge-sheet has been submitted against these petitioners showing them absconder vide Charge-sheet no. 46/2006 dated 30.04.2006 and cognizance has been taken against them for offences under Sections 364(A) and 120(B)/34 of the Indian Penal Code on 05.06.2009. The petitioners were evading their arrest since then.

Patna High Court Cr.Misc. No.46539 of 2018 (2) dt.25-08-2018 2/2 Learned counsel for the petitioners has submitted that they had no knowledge about submission of charge-sheet against them.

This Court in view the fact that petitioners are absconding for about nine years is not inclined to grant anticipatory bail to these petitioners. Accordingly, the prayer for anticipatory bail of the petitioners is rejected.

The petitioners are directed to surrender before the Court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail, which shall be considered on its own merit without being prejudiced by this order. The court below shall dispose of the bail petition of petitioner preferably on the same day.
