Petitioner, who is in custody, seeks bail in a case registered for the offences punishable under Section 366(A) of the Indian Penal Code.

Allegation against petitioner is that he enticed away the minor daughter of informant while she was sleeping in her house.

It has been submitted on behalf of the petitioner that he in innocent and has been falsely implicated in this case. It has been further submitted that occurrence took place on 27.08.2021 but FIR was lodged on 03.09.2021 after delay of 7 days without any explanation. It has been further submitted that statement of victim was recorded under Section 164 Cr.P.C. in

Patna High Court CR. MISC. No.65728 of 2021(2) dt.11-04-2022 2/2 which she has stated that she had gone out of her own volition and sweet will and she had love affair with petitioner and they have also solemnized marriage. Petitioner has no criminal antecedent and is in custody since 05.09.2021. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned court below, where the case is pending, in connection with Kashichak P.S. Case No. 167 of 2021, subject to conditions that:-

(1) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below.

(2) The petitioner shall fully cooperate with the investigation / trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (S. Kumar, J) Rajiv/veenaU T
