JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-10-2016 Supplementary affidavit is filed on behalf of the petitioner bringing his criminal antecedent on record. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 407, 406, 395, 34 of the Indian Penal Code.

Petitioner is not named in the first information report but in course of investigation, the name of petitioner came in this case on the basis of information furnished by spy of the police and thereafter, one co-accused, Loha Choudhary was arrested and made his confessional statement disclosing the involvement of the

Patna High Court Cr.Misc. No.30062 of 2016 (4) dt.04-10-2016 2/2 petitioner in the present crime. Moreover, co-accused, Loha Choudhary has already been granted privilege of bail by this Court and similarly, co-accused, Ranglal Choudhary has also been released on bail.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Dehri, Rohtas in connection with Dehri (Town) P.S. Case No. 548 of 2013.
