Petitioner is languishing in judicial custody since 21.02.2017 in connection with Antichak P.S. Case No. 08 of 2017 for offences punishable under Sections 25 (1-b)a, 26 of the Arms Act.

The prosecution case, as lodged by the police personnel, is that on information that absconding accused namely, Tibbha Mandal (petitioner) in connection with Sabour P.S. Case No. 189 of 2016 has come to attend his sister's marriage, the police conducted raid and the petitioner was apprehended and from his possession one country made pistol and two live

It has been submitted by the learned counsel for the petitioner that he is innocent and has been falsely implicated in the aforesaid case. He submits that charge-sheet has already been submitted and there is no allegation of tampering with the prosecution witnesses by the petitioner However, learned APP for the State opposes the prayer for bail stating therein that petitioner does not have clean antecedent and he was declared absconder in the previous case. Be that as it may, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XIV, Bhagalpur, in connection with Antichak P.S. Case No.
