====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 06-09-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 05.10.2018 in a case for the offence registered under Sections 392/34 of the IPC.

The prosecution story, in brief, is that the informant was working as staff in 'Haider Saree Centre'. On 24.06.2018 at 11.30 A.M., he proceeded for collecting the money from the shops of Waris Alam and Khalid Hussain and after collecting the money from a shop at Baradih, he also collected the money from other shops. As soon as, he stopped his vehicle at 4.30 P.M. at Parasthuan Chowk, Kudra More, in the meantime, two persons came with pistols and two persons were sitting on separate Motorcycles. Out of whom, one persons snatched bag containing money worth Rs. 6,50,000/- on the point of pistol

Patna High Court CR. MISC. No.55543 of 2019(2) dt.06-09-2019 2/2 and fled away.

It has been submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. The name of the petitioner has come on the basis of his self confession made in another case. There is no recovery of any incriminating article from possession of the petitioner. The petitioner has not been put on T.I. Parade.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is not named in the F.I.R. He has got criminal antecedent.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- I, Sasaram, Rohtas, in connection with Kochas (Parasathua) P.S. Case No. 118 of 2018.
