In view of the statement made by the respondent at paragraph5 of the counter affidavit where the petitioner himself has filed application for compounding of the case and his prayer has been allowed under the orders of the Divisional Forest Officer requiring the petitioner a deposit of Rs.1.50 lacs, then in my opinion, thereafter neither any appeal nor the revision nor this writ petition would be held maintainable for once the petitioner has taken recourse to the jurisdiction of compounding of offence which prayer has been allowed and the relief has been provided under the said order passed, it is for the petitioner to avail the same.
