The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a), 32, 41, 56(a) and 56(b) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 110 litres of country liquor was recovered from the motorcycle in question. The petitioner was taken into custody.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession or from the motorcycle. He is in custody since 31.7.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the petitioner not having any criminal antecedent, his having remained in custody for more than 8 months and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Complaint Excise Case no.104C2 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II-cum-Special Judge, Excise, Lakhisarai.
