JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-04-2015 Petitioner is languishing in custody since 26.07.2014 in a case registered for the offences punishable under Sections 498, 366/34 of the I.P.C.

Accusation is abducting the wife of the informant.

Though in 164 Cr.P.C statement the victim has suggested that she was being abducted, but it is submitted by learned counsel for the petitioner that the statement of the victim suggests that she of her own went in the company of the petitioner. Subsequently the informant has retracted from the initial version and has filed a petition to that effect before learned Court below.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the

No.13002 of 2015 (2) dt.02-04-2015 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sadar, East Champaran, Motihari in connection with Chhatauni P.S. Case No. 158 of 2014.
