Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B), 201 and 120B/34 of the Indian Penal Code.

The petitioner is in custody since 08.05.2016. The petitioner is husband of the victim and allegation is of commission of dowry death.

Earlier this Court had refused prayer for bail to the petitioner in Cr. Misc. No. 41930 of 2016 vide Annexure-1. Submission of the learned counsel for the petitioner is that the order sheet of the learned court below up to 10.10.2017 would reveal that no prosecution witness has been examined up-till-now which is a circumstance for re-consideration

Considering the period already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Rani Talab Police Station Case No. 22 of 2015, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
