The petitioner seeks regular bail in a case registered for the offences punishable under Sections 387, 467, 468, 471 and 120B of the Indian Penal Code.

The informant alleges that he received a call from Mobile No.9135151742 and caller demanded extortion of Rs.5 lacks. Learned counsel for the petitioner submits that the petitioner is not named in the FIR. Nothing has been recovered from the possession of the petitioner. The name of the petitioner figured in the confessional statement of co accused Sanjay Sahni. Mobile from which call was made to the informant does not belong to the petitioner. It appears from perusal of case diary that the name of the petitioner figured in the confessional statement of co-accused. Mobile No. 9135151742 was obtained after kidnapping of Niraj Kumar for

Patna High Court Cr.Misc. No.647 of 2015 (3) dt.02-02-2015 2/2 which Bochaha P.S.Case No. 42/2012 was registered. It appears that the sim was used by different persons, namely, Ajay Kumar Singh ,Vijay Sahni and others. The name of the petitioner has not figured as user of mobile.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Muzaffarpur, in Siwaipatii Case no. 03 of 2013.
