JUSTICE SUDHIR SINGH ORAL ORDER 05-09-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are languishing in custody in connection with Araria P.S. Case No. 191 of 2016 for the offence instituted under Section 364/34 of the Indian Penal Code. There is suspicion against the aforesaid petitioners for committing abduction of the daughter of the informant. It has been submitted on behalf of the petitioners that the petitioners are in custody since 20.04.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have been named in the First Information Report merely on the basis of suspicion. There is no eyewitness to

Patna High Court Cr.Misc. No.29392 of 2016 (3) dt.05-09-2016 2/2 support the allegation of abduction. There is no circumstantial evidence to suggest the implication of the petitioners in the present case.

On behalf of the state, it has been submitted that the petitioners are named in the First Information Report. Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria, in connection with Araria P.S. Case No. 191 of 2016.
