The petitioner seeks bail in Jandaha P.S. Case No. 160 of 2021, registered for the offence punishable punishable under Sections 414, 272, 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act. Total 1000 litres of country liquor has been recovered out of which 100 litres of country made liquor has been recovered from motorcycle of this petitioner. It is submitted that no recovery has been made from conscious possession of this petitioner. The motorcycle in question does not belong to this petitioner. Petitioner is in custody since 28.07.2021. Investigation is complete. Learned APP however vehemently opposed the prayer

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge II-cum-Excise Court, Vaishali at Hajipur in connection with Jandaha P.S.
