The petitioners apprehend their arrest in a case registered for the offence under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, on the instigation of petitioner no. 1, co-accused Randhir Kumar and petitioner no. 2 caught son of the informant and co-accused Ram Kripal Yadav shot him from pistol, due to which, he sustained injury. It is submitted on behalf of petitioners that petitioners have been falsely implicated in this case. Petitioners are father and son and on the alleged date of occurrence, they were not present at the place of occurrence. It is further submitted that after investigation, police submitted final form against petitioners, but differing with the same, learned Magistrate took cognizance against all the accused persons including petitioners.

Patna High Court CR. MISC. No.55261 of 2022(2) dt.22-12-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda at Biharsharif in connection with Harnaut (Telmar) P.S. Case No. 509 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
