JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-366(A)/34 of the Indian Penal Code. Petitioner is not named in the first information report but in course of investigation, when the statement of victim was recorded under Section-164 of the Cr.P.C., the name of peritioner surfaced and the victim claimed that she was kidnapped by Chandan Kumar and Anil Kumar as well as this petitioner and, subsequently, she was made captive in the house of the petitioner, Moreover, having more or less similar allegation, one co-accused namely, Chandan Kumar has already been granted privilege of bail by a coordinate bench of this court.

No.25859 of 2016 (2) dt.04-07-2016 2/2 Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Saraiya P.S. Case No. 271 of 2014 to the satisfaction of learned Sub Divisional Judicial Magistrate, West, Muzaffarpur.
