JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-05-2023 A bare perusal of paragraph no. 7 of the present writ petition would show that an encroachment case bearing Encroachment Case No. 1 of 2021-22 has already been initiated by the Circle Officer, Kotwa, District-East Champaran, hence, it is prayed that the same be directed to be disposed off within a stipulated time frame.

The learned counsel for the Respondent-State submits

Patna High Court CWJC No.14426 of 2022(2) dt.09-05-2023 2/2 that in case the aforesaid encroachment proceedings are still pending, the same shall be concluded within a stipulated time frame, as fixed by this Court.

Having regard to the facts and circumstances of the case, I deem it fit and proper to dispose off the present writ petition with a direction to the Circle Officer, Kotwa, DistrictEast Champaran, to dispose off the aforesaid pending Encroachment Case No. 1 of 2021-22, in case the same has not already been disposed off, by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, in accordance with law and after hearing the affected parties, within a period of six weeks of receipt / production of copy of this order.

The writ petition stands disposed off.
