Mr. Madhuri Lata, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 09-04-2015 Heard learned counsel for the petitioners, learned Additional Public Prosecutor assisted by learned counsel for the informant.

It has been alleged against both the petitioners along with Surendra Rai, Niraj Rai, Munna Rai armed with deadly weapons came and shot at Mondita Kuer for which informant Jinku Rai has instituted instant case. Furthermore, on account of firearm injuries deceased was referred to PMCH where she was declared dead.

From the postmortem report, it is apparent that single corresponding injury caused by firearm has been found which happens to be the cause of death. Furthermore, after perusal of the case diary, it is apparent that all the witnesses have stated that accused persons including these petitioners came and shot at. In the aforesaid background, none of them could be identified what to talk about these two petitioners, to be the author of the injury.

Patna High Court Cr.Misc. No.1154 of 2015 (4) dt.09-04-2015 Accordingly, petitioners Yogendra Ray @ Yogendra Ram, Birendra Ray @ Birendra Ram each are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Sahpur P.S.
