JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 31-08-2015 Heard learned counsel for the petitioner and the State. The petitioner prays for setting aside the order dated 04.01.2012, whereby the P.D.S. license of the petitioner, bearing license no. 22 of 1990, was cancelled.
The petitioner submits that his P.D.S. license has been cancelled on the ground mentioned in the show-cause. I find substance in the submission of the petitioner. In the facts and circumstances of the case, the impugned order cancelling the P.D.S. license of the petitioner is set aside. However, liberty is granted to the respondents to proceed afresh in the matter.
Now the inspection report has been annexed in the
Patna High Court CWJC No.19025 of 2013 (3) dt.31-08-2015 2 / 2 counter affidavit. The petitioner would be at liberty to file a detailed show-cause within four weeks from today. The licensing authority thereafter would proceed to dispose of the matter within a reasonable period.
This application stands disposed of.
